1. Introduction
Welcome to Xcloud. These Terms & Conditions govern your use of the Xcloud application, website, and related services.
By accessing or using Xcloud, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use Xcloud.
2. User Eligibility
By using Xcloud, you agree to comply with these Terms & Conditions and all applicable laws. Failure to comply may result in account suspension, content removal, termination, or other appropriate action.
2.1 Age Requirement
You must be at least 18 years old to use Xcloud.
By using Xcloud, you confirm that you meet this age requirement.
2.2 Legal Compliance
You must comply with all applicable local, national, and international laws when using Xcloud.
You must not use Xcloud for unlawful activities, including but not limited to:
Violating copyright, trademark, patent, or other intellectual property rights.
Sharing or distributing illegal, defamatory, fraudulent, or harmful content.
Engaging in harassment, threats, hate speech, or discrimination.
Uploading or distributing malware, viruses, hacking tools, or other harmful software.
Violating applicable privacy or data protection laws.
Engaging in fraud, money laundering, or other financial crimes.
2.3 Restricted & Prohibited Users
You may not use Xcloud if:
Your use of the service is prohibited by applicable law.
You are located in a country or region where the service is restricted by law.
You are using the service in violation of applicable sanctions or legal restrictions.
You have previously been permanently banned from Xcloud and attempt to circumvent the ban.
2.4 Account Verification & Security
If we reasonably suspect fraud, misuse, unauthorized activity, or violations of these Terms, we may suspend or terminate your account and/or restrict access to content.
You are responsible for maintaining the security of your account and login credentials. You must not share your credentials with others or allow unauthorized persons to access your account.
2.5 Consequences of Violations
If you violate these Terms, we may take one or more of the following actions:
Suspend or terminate your account.
Remove or restrict access to uploaded content.
Restrict specific features.
Permanently ban you from using Xcloud.
Report unlawful activity to appropriate authorities where required or permitted by law.
3. User Accounts
Certain features of Xcloud may require you to create or access an account.
You agree that:
You will provide accurate information when required.
You are responsible for maintaining the security of your account.
You will not share your login credentials with others.
You will not use another person's account without authorization.
You will notify us if you believe your account has been accessed without authorization.
You are responsible for activities performed through your account unless the activity resulted from unauthorized access that was not caused by your failure to maintain account security.
4. User-Generated Content
Xcloud may allow users to upload, store, manage, download, stream, or share files, videos, images, documents, links, and other content.
4.1 Ownership
You retain ownership of content that you upload to Xcloud.
Xcloud does not claim ownership of your user-generated content.
4.2 User Responsibility
You are solely responsible for the content you upload, store, stream, download, or share through Xcloud.
You must ensure that you have all necessary rights, permissions, and licenses required to use and distribute your content.
4.3 Prohibited Content
You must not upload, store, distribute, or share:
Illegal or unlawful content.
Content that infringes copyrights, trademarks, patents, or other intellectual property rights.
Malware, viruses, ransomware, phishing materials, or other harmful software.
Content intended to facilitate fraud or other illegal activities.
Content containing threats, harassment, or targeted abuse.
Hate speech or content promoting violence or discrimination.
Pornographic or sexually explicit content.
Content that unlawfully exposes another person's private or confidential information.
Content that impersonates individuals or organizations for fraudulent or deceptive purposes.
5. License to Operate the Service
By uploading content to Xcloud, you grant Xcloud a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, transmit, and display your content only to the extent reasonably necessary to provide, operate, maintain, secure, and improve the Xcloud services.
This license does not transfer ownership of your content to Xcloud.
The license ends when your content is deleted from our active systems, except where retention is required for legal, security, backup, fraud-prevention, or legitimate operational purposes.
6. Platform Information
Xcloud may allow users to upload, store, manage, stream, download, and share content through private or public features.
Users are solely responsible for the content they upload or share.
Xcloud does not assume ownership of user-generated content and is not responsible for the legality, accuracy, completeness, or quality of content uploaded by users.
You use and share user-generated content at your own risk.
7. Downloading Content
7.1 User-Generated Content & Downloading
Where Xcloud provides downloading functionality, users may download content that has been made available to them.
Users are responsible for ensuring that their downloading and subsequent use of content complies with applicable laws and intellectual property rights.
7.2 Privacy & Personal Data
Downloading content does not necessarily reveal personal information about the content owner to the downloader.
Users should avoid including private, confidential, or sensitive personal information in content that they make publicly accessible.
7.3 Copyright & Intellectual Property
Users must ensure that they have the necessary rights to upload, share, or make content available for downloading.
Downloading content does not transfer ownership or intellectual property rights to the downloader.
If you believe content available through Xcloud infringes your copyright or other intellectual property rights, you may contact us for review.
7.4 Restrictions on Misuse
Downloaded content must not be used for:
Illegal activities.
Copyright infringement.
Fraud or deception.
Harassment or abuse.
Distribution of malware or harmful software.
Any other unauthorized or unlawful purpose.
We may restrict access to content or accounts where we identify misuse or violations of these Terms.
7.5 Third-Party Content
Xcloud is not responsible for the accuracy, legality, availability, or appropriateness of content uploaded or shared by users or third parties.
Any content accessed or downloaded through Xcloud is accessed at your own risk.
8. Channels & Sharing
Xcloud may provide functionality that allows users to create and manage channels or other areas for uploading, storing, and sharing content.
8.1 User Responsibility
Channel owners are responsible for content uploaded or shared through their channels.
Users must ensure that their channels and content comply with these Terms and applicable laws.
8.2 Prohibited Channel Content
Users must not use channels to upload, store, or distribute:
Illegal content.
Unauthorized copyrighted movies, music, television shows, or other protected works.
Hate speech or content promoting violence or discrimination.
Pornographic or sexually explicit content.
Malware, viruses, phishing links, or fraudulent content.
Impersonation or deceptive content.
Content intended to facilitate illegal activities.
8.3 Content Reporting & Removal
Users may report content that they believe violates these Terms or applicable law by contacting us using the contact information provided below.
Xcloud may review reported content and, where appropriate, remove content, restrict channels, suspend accounts, or take other action.
Repeated or serious violations may result in permanent account termination.
8.4 Intellectual Property
Users retain ownership of content uploaded to their channels.
By uploading content, users grant Xcloud the limited license described in Section 5, solely for operating and providing the services.
Users must have the necessary legal rights to share the content.
8.5 Privacy & Security
Channel owners should avoid publicly sharing personal, confidential, or sensitive information.
Xcloud is not responsible for information that users voluntarily make public through channels or other sharing features.
8.6 Consequences of Violations
If a channel violates these Terms, Xcloud may:
Remove individual content.
Restrict or delete the channel.
Suspend or terminate the associated account.
Restrict access to specific features.
Report violations to appropriate authorities where legally required or appropriate.
9. Streaming Links & Copyright Compliance
Where Xcloud allows users to add or access streaming links:
Users must have the necessary rights to use and share those links.
Users are responsible for ensuring that their streaming activities comply with applicable laws.
Xcloud does not claim ownership of third-party content accessed through external links.
Xcloud is not responsible for copyrighted material hosted on third-party websites or services.
We may remove or restrict links following a valid copyright complaint or policy violation.
9.1 Optional Technical Data
When certain streaming features are accessed through our web portal, we may collect technical information such as cookies, referrer information, user-agent information, and origin information where necessary for functionality, security, analytics, or service improvement.
Any such information is handled according to our Privacy Policy.
10. Content Removal & Account Termination
Xcloud reserves the right to remove content, restrict features, suspend accounts, or terminate accounts when:
These Terms are violated.
Applicable law requires action.
Content infringes intellectual property rights.
Fraud, abuse, or security risks are detected.
The account is involved in harmful or unlawful activities.
Action is reasonably necessary to protect Xcloud, its users, or third parties.
Users may request deletion of their accounts at any time.
Some information may be retained where necessary for legal, security, fraud-prevention, dispute-resolution, backup, or other legitimate purposes.
11. Acceptable Use Policy
You agree not to:
Use Xcloud for unlawful purposes.
Circumvent security features or access controls.
Attempt to hack, disrupt, overload, or interfere with Xcloud.
Reverse engineer or attempt to gain unauthorized access to the service, except where such restriction is prohibited by applicable law.
Introduce malware, viruses, or other harmful code.
Attempt to access another user's account or private content without authorization.
Collect or misuse another user's personal information.
Use automated systems in a manner that places unreasonable load on the service.
Abuse or exploit Xcloud features for fraudulent or harmful purposes.
12. Availability & Service Changes
Xcloud is provided on an "AS IS" and "AS AVAILABLE" basis.
We may modify, suspend, discontinue, or restrict all or part of the service at any time, including individual features, storage capabilities, channels, streaming functionality, or other services.
We do not guarantee that Xcloud will always be available, uninterrupted, secure, or error-free.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Xcloud and its operators will not be responsible for indirect, incidental, special, consequential, or similar damages arising from your use of the service.
This includes, where applicable:
Loss or corruption of data.
Loss of uploaded content.
Service interruptions.
Technical problems.
Third-party content.
Third-party websites or services.
Unauthorized access resulting from circumstances outside our reasonable control.
User-generated content.
Content streamed, downloaded, or shared by users.
You use Xcloud at your own risk.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
14. Third-Party Services
14.1 Third-Party Integrations
Xcloud may integrate with or provide access to third-party services, including analytics providers, cloud infrastructure, authentication services, media services, payment providers, advertising providers, and other third-party tools.
These third-party services operate independently and may have their own Terms & Conditions and Privacy Policies.
14.2 External Links & Advertisements
Xcloud may contain links, advertisements, embedded content, or integrations from third parties.
We do not control or assume responsibility for third-party websites, services, content, or privacy practices.
Users should review the applicable terms and privacy policies of third-party services before using them.
14.3 Changes to Third-Party Services
We may add, modify, or remove third-party integrations at any time.
Continued use of Xcloud after such changes constitutes acceptance of these Terms to the extent permitted by applicable law.
15. In-App Purchases
Xcloud may offer paid features, digital products, subscriptions, or other purchases through Google Play Billing.
Payments are processed through Google Play.
Xcloud does not directly collect or store your payment card or other payment credentials used for Google Play purchases.
Purchase and subscription information may be provided to Xcloud as necessary to verify transactions and provide purchased features.
Subscriptions may automatically renew according to the applicable Google Play subscription terms unless canceled before renewal.
Users can manage eligible subscriptions through their Google Play account.
Refunds are handled according to applicable Google Play policies.
Upon successful purchase, you receive a limited, personal, non-transferable license to use the purchased feature or service within Xcloud, subject to these Terms.
16. Intellectual Property
The Xcloud application, website, branding, logos, designs, software, interfaces, and other materials provided by Xcloud may be protected by applicable intellectual property laws.
Except for user-generated content, you may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit Xcloud's proprietary materials without authorization, except where permitted by applicable law.
17. Privacy
Your use of Xcloud is also subject to our Privacy Policy, which explains how we collect, use, store, and protect information.
The Privacy Policy forms part of these Terms & Conditions.
18. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our services, technology, legal requirements, or business practices.
When we make changes, we may update the "Last Updated" date.
Your continued use of Xcloud after the updated Terms become effective means that you accept the revised Terms, to the extent permitted by applicable law.
19. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by law.
